A signed sale agreement is a milestone, but the property still needs to reach registration and handover. The agent’s practical challenge is to coordinate the parties, documents, funds and any bank or developer requirements in the right sequence.
What you will learn: Prepare a resale transaction for transfer and identify where financing changes the coordination.
What should be checked before agreeing milestones?
Confirm the seller’s identity and authority, the property record, occupancy status and the terms of the sale. Identify any mortgage, outstanding obligation or special ownership arrangement that affects the transaction.
Ask whether the buyer is paying cash or seeking finance. A buyer’s general affordability estimate should not be treated as final lender approval. Any relevant financing condition should be addressed in the transaction terms.
Why do the NOC and payment arrangements matter?
For applicable freehold transfers, DLD’s sale-registration service lists an electronic developer no-objection certificate among the required documents. Confirm the current requirements for the property and transaction.
Agree how outstanding charges will be dealt with and which party prepares each payment. Check payment methods and beneficiaries against the official service requirements and the transaction documents. Avoid leaving these questions until the transfer appointment.
What changes if the seller has a mortgage?
The bank’s outstanding balance and release requirements become part of the transaction sequence. DLD has a specific service for registering the sale of a mortgaged property, with completion linked to submission of the mortgage-release letter.
Obtain the required bank information and coordinate settlement, release and registration through the appropriate process. If the buyer is also borrowing, both lender arrangements must be reconciled; clearing the seller’s loan does not by itself secure the buyer’s financing.
What happens at registration?
The parties or their authorised representatives use the applicable DLD registration channel. Documents are checked, transaction details are processed and the required payments are made. The issued ownership record should then be checked for accuracy.
Do not assume a published service-processing time covers the entire deal. Bank preparation, developer documents, corrections and appointment coordination can take additional time.
Organise the transfer by responsibility
| Workstream | Who needs to confirm the position? | What makes the file ready? |
| Parties and authority | Seller, buyer and any authorised representatives | Correct identity and authority documents |
| Developer requirements | The relevant developer or service channel | Applicable NOC and outstanding-obligation arrangements |
| Seller’s borrowing | Seller and existing lender | Settlement and mortgage-release procedure confirmed |
| Buyer’s borrowing | Buyer and proposed lender | Required approval, valuation and funding steps established |
| Registration | The applicable DLD channel or Trustee Office | Accepted documents, payment arrangements and attendance |
| Possession | The transaction parties and relevant occupier | Agreed keys, tenancy and handover arrangements |
The workstreams can overlap, but each has its own dependency. Mortgage settlement alone does not establish that all registration requirements are complete.
Practise a readiness review
Compare DLD’s published sale and mortgaged-sale service requirements. Apply the resulting map to a real transaction file when one is available to you. Give each workstream one status: complete, awaiting confirmation or requiring action. Add an owner and next step to every incomplete item.
Learning checkpoint: Explain why a planned appointment date is different from a transfer-ready file. The answer should identify the actual documents, funds and approvals still needed.
Common questions
Can a tenanted property be sold?
A sale may involve a tenanted property, but occupancy and the applicable tenancy obligations must be understood. Do not promise vacant possession without verifying the position.
Is a cash purchase always immediate?
No. It removes the buyer-financing step but does not remove document, ownership, developer or registration requirements.
Key takeaway
A successful transfer depends on preparation and sequencing. Identify the transaction’s specific requirements before committing the parties to a completion date.
